1. Platform Scope
ZSky AI is an AI-powered content generation platform designed for adult users (18+). The platform enables users to generate images, videos, and other media using artificial intelligence models. 17 U.S.C. § 512 (DMCA)3. Legal Basis
Our content policies are grounded in the following federal statutes, among others:
- 18 U.S.C. § 2256 — Definitions related to sexual exploitation and abuse of children. Establishes the legal definition of "sexually explicit conduct" and "visual depiction" as applied to minors.
- 18 U.S.C. § 1466A — Criminalizes obscene visual representations of the sexual abuse of children, including drawings, cartoons, sculptures, and computer-generated images. This statute extends protection beyond photographic images to any visual depiction.
- 18 U.S.C. § 2257 — Record-keeping requirements for producers of sexually explicit content. Requires producers to verify and maintain records of the identity and age of every performer depicted.
- 18 U.S.C. § 2258A — Mandatory reporting obligations for electronic service providers who obtain knowledge of apparent violations involving CSAM. Requires reporting to the National Center for Missing & Exploited Children (NCMEC).
- 18 U.S.C. § 2252 / 2252A — Prohibitions on the production, distribution, receipt, and possession of child pornography, including computer-generated images indistinguishable from actual minors.
ZSky AI maintains compliance with all applicable federal, state, and local laws. As AI-generated content technology evolves, we continuously update our policies to reflect new legal developments and best practices.
4. Automated Enforcement
ZSky AI employs multiple automated systems to prevent the generation of prohibited content:
4.1 Prompt Scanning
Every text prompt submitted to our generation models is analyzed in real time before processing begins. Our systems check for:
- Explicit references to minors, children, underage individuals, or related terms.
- Keywords and phrases associated with prohibited content categories.
- Evasion techniques including misspellings, coded language, and obfuscation patterns.
- References to real, identifiable individuals in prohibited contexts.
Prompts that trigger safety filters are blocked immediately. The generation request is denied and the attempt is logged.
4.2 Pattern Matching and Output Analysis
Generated content may be analyzed post-generation using automated classifiers trained to detect:
- Visual indicators of underage subjects.
- Known CSAM hash signatures (PhotoDNA and similar technologies).
- Content matching prohibited categories.
4.3 Rate Limiting and Behavioral Analysis
Accounts that repeatedly trigger safety filters, exhibit patterns consistent with policy evasion, or demonstrate suspicious behavior are subject to enhanced monitoring, temporary suspension, or permanent termination.
5. Reporting and Law Enforcement Cooperation
5.1 Mandatory Reporting (CSAM)
In compliance with 18 U.S.C. § 2258A, ZSky AI will submit a CyberTipline report to the National Center for Missing & Exploited Children (NCMEC) whenever we obtain actual knowledge of any apparent violation involving child sexual abuse material. Reports include all available information about the content, the user, and the circumstances of the violation.
5.2 Law Enforcement Cooperation
ZSky AI fully cooperates with law enforcement agencies investigating violations of federal, state, and local law. Upon receipt of a valid legal process (subpoena, court order, search warrant, or emergency disclosure request), we will provide all relevant records, including:
- Account registration information.
- IP addresses and access logs.
- Generation history and prompt logs.
- Payment records and billing information.
- Any generated content still within our retention period.
In emergency situations involving imminent danger to a person (particularly a child), we may disclose information to law enforcement without prior legal process, as permitted under 18 U.S.C. § 2702(b)(8).
5.3 Evidence Preservation
Upon detection of a potential violation or receipt of a preservation request from law enforcement, we will preserve all relevant records for a minimum of 90 days (extendable upon request) to ensure evidence is available for investigation and prosecution.
6. User Reporting
We encourage users to report any content or behavior that they believe violates this Content Policy. Reports can be submitted through the following channels:
- Email: safety@zsky.ai
- In-Platform: Use the reporting feature available on generated content (when applicable).
All reports are reviewed promptly. You will not be penalized for making a good-faith report. We may not be able to disclose the specific outcome of an investigation due to privacy and legal considerations.
If you believe a child is in immediate danger, contact the National Child Exploitation Tip Line at 1-800-THE-LOST (1-800-843-5678) or report online at CyberTipline.org.
7. Consequences of Violations
Zero Tolerance: Any violation involving CSAM, minor exploitation, non-consensual imagery, or other illegal content results in immediate, permanent, and irreversible account termination. There is no appeal process for these violations.
7.1 Tiered Enforcement
- Tier 1 — Immediate Permanent Ban: CSAM or minor exploitation, non-consensual imagery of real people, deepfakes of real people, and any content that constitutes a federal or state crime. Account terminated, all data preserved for law enforcement, CyberTipline report filed where applicable.
- Tier 2 — Immediate Permanent Ban: Bestiality, necrophilia, snuff content, extreme gore pornography, and real person exploitation or harassment. Account terminated immediately.
- Tier 3 — Warning to Permanent Ban: Repeated attempts to circumvent safety filters, copyright infringement, or other violations not covered by Tiers 1-2. Enforcement ranges from warnings and temporary suspensions to permanent termination based on severity and frequency.
7.2 No Refunds for Violations
Users whose accounts are terminated for policy violations forfeit all remaining credits, unused subscription time, and any stored content. No refunds will be issued.
7.3 Permanent Record
Accounts terminated for Tier 1 or Tier 2 violations are permanently flagged. The associated email addresses, IP addresses, and payment identifiers are recorded to prevent re-registration. Attempting to create a new account after a Tier 1 or Tier 2 ban constitutes a further violation.
8. Updates to This Policy
We may update this Content Policy from time to time as laws evolve and as we refine our safety practices. Material changes will be communicated through our Service. Your continued use of ZSky AI after changes take effect constitutes your acceptance of the updated policy.
